A 28-year-old American showed up at Amsterdam's Schiphol Airport, filed for asylum in the Netherlands, and asked a Dutch court to declare the United States too dangerous to return to. Seven days later, the court said no.
Not "maybe." Not "we'll review it." No.
Veronica Clifford-Carlos, a transgender woman from San Francisco, claimed she faced death threats, street harassment, and hospital discrimination in one of the most progressive cities on Earth. She argued that Donald Trump's election made conditions in the United States intolerable for someone like her. The Dutch court in Amsterdam acknowledged that conditions "worsened since the election of president Donald Trump" and called certain policies "worrying" — then ruled against her anyway.
The legal standard the court applied is worth reading carefully. Clifford-Carlos had to demonstrate a "personal and genuine risk of persecution, not only hostile policies." Disagreeing with an administration's direction doesn't qualify. Feeling unsafe doesn't qualify. You need evidence of actual, personal persecution — the kind that would make a country genuinely dangerous.
The court found she "retained access to health care, education, social services, and legal protection" in the United States. All four. Health care, education, social services, legal protection. The stuff that actual failed states don't provide. A European court looked at Trump's America and concluded: the systems still work.
This is the same European judicial apparatus that lectures us annually about human rights, detention conditions, and immigration enforcement. The same continent where politicians campaign on how brutal and backwards America has become. Their own courts just certified, in a binding legal ruling, that the United States under Trump remains a functioning country where citizens retain their fundamental protections.
Clifford-Carlos is allowed to remain in the Netherlands while her case undergoes further review. But chose to return to America once she saw the migrant camp they were placing her in while she waited. She said she thought her life was in danger living amongst the Islamic refugees.
Supporters of the asylum bid referenced Germany in the 1930s — comparing modern America to the rise of Nazism. The Dutch court, apparently, did not find that comparison persuasive when measured against the fact that Clifford-Carlos came from San Francisco, had access to every public service, and faced no criminal charges or government action whatsoever.
The American left has spent years insisting this country is a fascist hellscape under Republican governance. They've said it on cable news, in congressional hearings, on fundraising emails, in campus lectures. They've built entire media brands around the premise that Trump's America is a place people need to escape from.
A European court just weighed that claim on the legal scales and found it weighed nothing.
